Sealed proposals, addressed to Tyler Junior College, Texas, will be received in the office of the Director of Purchasing and Central Services, at 1327 South Baxter Avenue, Tyler, Texas 75701, until 2 p.m., January 8, 2009, for furnishing necessary materials, equipment, superintendence and labor for Tennis Court Improvements, being improvements for Tyler Junior College, Tyler, Texas.
Bids must be submitted in sealed envelopes, on the proposal form provided in the contract documents, and marked in the upper left-hand corner with the bid project name and the time and date the bid is to be opened.
Bidders must submit an acceptable Cashier's or Certified Check upon a national or state bank in the amount of five percent (5%) of the total maximum bid payable without recourse to Tyler Junior College, Texas, or an acceptable Bid Bond in the same amount from a reliable surety company, registered by the State Board of Insurance to conduct business in the State of Texas, and acceptable according to the most recent list of the companies holding Certificates of Authority from the Secretary of the Treasury of the United States, shown on the Treasury List, as a guarantee that the bidder will enter into a contract and execute required Statutory Performance/Maintenance and Payment Bond on the form provided within fifteen (15) calendar days after notice of an award of Contract. The bid security must be enclosed in the same envelope containing the bid. Bids without the required enclosed check or Bid Bond will not be considered. All bid securities will be returned un-negotiated, after the bids are opened, except those of the three (3) lowest bidders, which Tyler Junior College may elect to hold until the successful bidder has executed the Contract.
The cost of the work to be performed under this Contract will be financed with funds furnished by Tyler Junior College.
Tyler Junior College reserves the right to reject any or all bids and to waive any formalities. No bids may be withdrawn within sixty (60) days of the bid opening.
It will be the bidder?s responsibility to ensure that all unit prices written in words will be clear and legible. Illegibly written unit prices will result in the bid being rejected, and will not be considered as an irregularity of the bid. In case of a discrepancy between the unit price written in words, the unit price written in figures, and/or the item extension written in figures, the unit price written in words will govern.
Unit prices are used by Tyler Junior College in scheduling interim payments to the Contractor. The unit price written in words, multiplied by the estimated bid quantity, will be used to determine the item extension and the actual total bid price. All mathematical errors found when the bids are tabulated will be corrected by Tyler Junior College and the bids will be revised to reflect the corrected item extension and/or total bid price. The corrected total bid amount will then become the official bid for that Contractor. All bidders will be notified of any errors in their bid, and will be notified and given the opportunity to review the official bid tabulation prior to award recommendation.
The unit prices shown in the bid proposals must be balanced so as to reflect the actual cost of the item, including a fair and reasonable cost for overhead and profit. If the unit price is considered to be unbalanced, Tyler Junior College reserves the right to reject the entire bid. If required by Tyler Junior College, the Contractor will provide documentation to substantiate that the unit prices reflect fair and reasonable material costs, labor costs, overhead and profit, as determined by industry standards.
The successful bidder must furnish a Statutory Performance/Maintenance and Payment Bond, upon the form provided, in the amount of one hundred percent (100%) of the Contract Price, from an approved surety company holding a permit from the State of Texas and registered by the State Board of Insurance to conduct business in the State of Texas, and acceptable according to the most recent list of the companies holding Certificates of Authority from the Secretary of the Treasury of the United States, shown on the Treasury List, to act as surety, or any other surety or sureties acceptable to Tyler Junior College. The Maintenance Bond will terminate one (1) year from the date of written acceptance of said job completion. For bids less than $25,000, a Performance Bond, Payment Bond and Maintenance Bond will not be required.
The bid package must consist of the following items: 1. The Acknowledgment of all Addenda 2. The Proposal 3. The Bid Bond
Any bid received without each of the required items will be rejected and will not be read at the bid opening.
Forms of proposal, contract, bonds, and plans and specifications may be obtained at the office of the Engineer, The Brannon Corporation, 1321 South Broadway, Tyler, Texas 75701, (903)597-2122.
Bidders should carefully examine the plans, specifications and other documents, visit the site of the work, and become fully informed of all conditions and matters which can in any way affect the work or the costs thereof. Should a bidder find discrepancies in, or omissions from the plans, specifications or other documents, or be in doubt as to their meaning, or any questions regarding the Plans and Specifications must be submitted to the Engineer, Bob Breedlove, P.E., in writing by fax to 903-5973346. Questions submitted within 48 hours of the bid opening will not be answered.
All out-of-state contractors are required to submit with their bid a copy of any law from their state of residence which would give a preference for government contracts to contractors domiciled in their state over out-of-state contractors.
The project includes: Tennis Court Improvements, fencing, concrete paving, and concrete pavers.
